Charge: CHILD PORNOGRAPHY

This is one of the most easy traps for any defendant.  Generally, most people say: “I would never commit that crime.”  However, believe it or not, most people have. Entering onto an unknown website, or downloading unknown data can easily be a trap. Even images not opened can be declared by the State to have entered onto your system. Images can come onto your system without knowledge and are known in the trade as “caved files.” You may not have viewed the image, yet you could have been reported to law enforcement as if you had. Such files even require special software to have observed them. However, likewise, you may be accused of even viewing such data.   Even researching sites can get you arrested. Trust me!

            Child pornography is likewise one of those areas wherein the State plays hardball. Their attitude becomes frequently, so to speak, sanctimonious, when they have a strong case. However, there are manners to fight such prosecutorial bullies.

            First, despite claims by Prosecutors, not every image falls clearly within the confines of pornography.  There are limitations. Everyone that practices in this area needs to be aware of them. Frequently, few are.  I have argued many cases in this field. I have dealt with the topic frequently and beyond the measure of others. 

            Second, retaining a forensic expert is key.  Someone needs to understand how the data ended up where it was found by the State.  Without going into much detail, it is key to understanding how to attack this data.  I understand the techniques and have my own process.  This process has been achieved by years of practice together with studying every case on the subject.  Again, that comes from practice and not pleading.

            Third, once the information is examined, an attorney needs to know how to exclude such information at trial.  If charged, we can discuss such techniques in the confines of my office.
